NJ & PA Legal Considerations New Jersey (NJ) NJ follows one-party consent for audio recordings (N.J.S.A. 2A:156A-4) However, informed consent is strongly recommended for all parties in this App Certain contexts (e.g., sexual consent) may still be legally challenged regardless of documentation Pennsylvania (PA) PA is a two-party (all-party) consent state (18 Pa. Cons. Stat. § 5703) You MUST obtain consent from all parties before recording or storing any interaction Important By using ConsentOK, you agree: You are responsible for complying with your local laws You will not rely solely on this App as legal proof 4. In-App Consent Flow (Tap-to-Agree Compliance) ConsentOK implements the following required user flow: Step 1: Pre-Consent Disclosure Screen Users must confirm: “I understand this is not legal advice” “All parties must voluntarily agree” “Recording laws vary by state” Step 2: Multi-Party Acknowledgment Each participant must: Individually tap “I Agree” Confirm identity (name or identifier) Acknowledge: They are acting voluntarily They understand the terms Step 3: Final Confirmation Screen All parties confirm: “This agreement was made without coercion” “All participants consent to documentation” Step 4: Optional Recording Notice If recording is used: Display: “Recording in progress with consent of all parties” 6. Prohibited Use You may NOT use ConsentOK to: Facilitate illegal acts Coerce or manipulate individuals Record without proper consent (especially in PA) Misrepresent identity or intent 7. No Legal Advice ConsentOK does not: Provide legal counsel Replace an attorney Guarantee enforceability in court 8. Data Responsibility You are responsible for: Ensuring lawful data collection Obtaining permission before storing personal data 9. Third-Party Platform Compliance Apple App Store Apple is not responsible for the App or its content Apple provides no maintenance/support obligations Apple is a third-party beneficiary of these Terms Google Play Use must comply with Google Play policies Google is not liable for your use of the App 10.
